Arbitration is a voluntary  dispute resolution process in which the arbitrator makes the final decision. It is similar to mediation, whereby the arbitrator is a neutral party who facilities a hearing, however the  arbitrator makes a final award at the end which is legally binding in court and  can be converted to a court order.  The decision is based upon the evidence provided  by the parties for the hearing and witnesses testifying. At times many cases which do not settle in mediation can be escalated into arbitration for final settlement and closure.

There are many benefits to arbitration as an alternative for setting your case in court including:

THE LENGTH OF PROCESS

In many  cases arbitration can settle a legal dispute much quicker, rather than taking your matter to court. Arbitration cases can at times be settled in a one day hearing within a month or two, depending on the particulars of the case, as opposed to a lengthy court case which can take anywhere from two to seven years.

PRIVATE PROCESS

Arbitration is a completely  private process and not like court cases which become public.  It provides parties complete confidentiality over their private business and financial matters.  The award also remains private and is not reported.

CASE MANAGEMENT

You  get to work with one arbitrator  and/or tribunal  throughout your entire case,  as opposed to taking your matter to court, where you may end up with different judges throughout your case.

YOU HIRE THE ARBITRATOR

Choosing your  arbitrator allows you the benefit of hiring the right person for your dispute, including one  who has the proper expertise, knowledge  and experience related to your individual  case.  You may also choose to have a tribunal with up to 3 arbitrators for your case.
